These conditions of sale govern the sale of products marketed by BIRRIFICIO BARONI BIRRA s.r.l. (hereinafter referred to as Baroni Birra for the sake of brevity) through the website https://baronibirra.it/. All contracts for the purchase of products concluded, through the aforementioned website and according to the procedures indicated here, between the seller and the Customer, will be governed by these conditions of sale (in accordance with Italian law and in particular with Legislative Decree 70 /2003 relating to electronic commerce and Legislative Decree 206/2005 with specific reference to the legislation on distance contracts). Any changes or new conditions of sale will be promptly notified to the Customer, will be effective from the moment of publication on the site and will be applied only to sales concluded after publication.
ACCEPTANCE OF THE TERMS OF SALE
The contract stipulated between Baroni Birra and the Customer must be considered concluded with the acceptance of the order by Baroni Birra. Acceptance is considered tacit, unless otherwise communicated in any way to the Customer. By placing an order in the various ways provided, the Customer declares to have read the information provided during the purchase procedure and to accept the conditions transcribed below. The Customer is therefore invited to read these conditions of sale carefully and to print them or save them on another durable medium accessible to him.
HOW TO PURCHASE
The customer can only purchase the products on the website https://baronibirra.it/ at the time of placing the order as described in the relevant information sheets. The information supplied with the products reproduces those provided by the manufacturers. Baroni Birra, therefore, reserves the right to modify the product information to adapt them to those provided by the producers, without the need for prior notice. The images on the site are provided to the Customer to facilitate the recognition of the products, due to variations in the packaging by the manufacturer, the photos may not exactly reflect the appearance of the delivered product. Correct receipt of the order is confirmed by Baroni Birra by means of an e-mail reply, sent to the e-mail address communicated by the Customer. This confirmation message will contain the date and time of receipt of the order and an "Order Number", to be used in any further communication with Baroni Birra, as well as a reference to these conditions of sale. In the event of non-acceptance of the order, Baroni Birra undertakes to promptly notify the Customer. All prices on the site are to be understood as prices to the public and, therefore, inclusive of VAT. Baroni Birra reserves the right to change prices at any time, without notice. Public prices do not include any taxes, duties and taxes applicable in the country of destination of the products and/or services where this is different from Italy. These costs, which differ from country to country, are charged to the customer, who is responsible for verifying the amount with the competent customs authorities. Upon written request, we will reimburse the customer for the costs incurred.
Terms of payment
The Customer can purchase the products on the Baroni Birra website using various forms of payment, as indicated in the purchase procedure. Any additional costs relating to a specific payment method will be explicitly highlighted during the purchase procedure itself.
Delivery methods
Baroni Birra delivers its products via specialized couriers. Shipping costs, in general, are charged to the customer and are explicitly highlighted at the time the order is placed. Depending on the destination area of the goods, deliveries may take place in a period of time ranging from 24 hours to 4 days, barring setbacks (in any case within thirty days from the date of the order). Upon receipt of the goods, the Customer is required to verify their integrity, if the customer has doubts about the integrity of the same, he must indicate it on the delivery receipt. The customer will have 14 working days to check the integrity of the goods and notify any damage in writing via email to info@baronibirra.it. Within 14 working days, Baroni Birra will refund the customer.
Right of withdrawal
The Customer has the right to withdraw from the contract, without any penalty and without specifying the reason, within 14 working days of delivery of the purchased products, in accordance with correctness and good faith, upon written notice to be sent to Baroni Birra by e-mail at address info@baronibirra.it. In the communication, the Customer must indicate the product or products for which he intends to exercise the right of withdrawal. The return costs are charged to the customer. Baroni Birra will reimburse the Customer for all payments received for the product or products for which he has exercised the right of withdrawal (including the original delivery costs) within 14 days of the customer's communication.
Warranties
Baroni Birra guarantees that products equal to those indicated and described on the site will be delivered. The manufacturer's liability applies to all products sold. The manufacturer is also responsible for the truthfulness and completeness of the information on the packaging.
Privacy
The personal data requested during the order forwarding phase are collected by Baroni Birra and processed on IT supports, in order to satisfy the obligations arising from the contract concluded with the Customer and will in no case and for any reason be transferred to third parties . Baroni Birra guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code pursuant to Legislative Decree No. 196 of 06.30.03. The data controller is Birrificio Baroni Birra s.r.l., Via Roma 185 – 91025 Marsala (TP), in the person of its pro tempore legal representative, unless a manager is appointed pursuant to art. 29 of Legislative Decree no. 196/2003. The customer, at any time, has the right to revoke consent to the processing of personal data with written communication to be sent to Baroni Birra, at the above address. The customer, pursuant to art. 7 of Legislative Decree no. 196/2003, has the right to access their data according to the methods provided therein. Marketing communications will be sent only with the explicit consent of the Customer issued together with the authorization to process and send it in the online registration form.
Protection of minors
Baroni Birra does not sell alcoholic products to minors under the age of 18. The courier will not deliver alcoholic products to minors under the age of 18 and may request an identity document to verify age.

Any complaint must be addressed in writing to Birrificio Baroni Birra s.r.l., Via Roma 185 – 91025 Marsala (TP) or by email to info@baronibirra.it.
JURISDICTION AND GOVERNING LAW
The sales contract between the Customer and Baroni Birra is understood to be concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Trapani.

Online dispute resolution for consumers
The consumer residing in Europe should be aware of the fact that the European Commission has set up an online platform that provides an alternative dispute resolution tool. This tool can be used by the European consumer to resolve any dispute relating to and/or deriving from contracts for the sale of goods and services entered into on the net in a non-judicial manner.
Consequently, if you are a European consumer, you can use this platform for the resolution of any dispute arising from the online contract stipulated with the Data Controller.
